Acceptable Use Policy

Studio Makker LLC — Empress

Draft — not yet dated for publication

This policy applies to every Empress workspace, whether its sites run on Studio Makker's Cloudflare account (pooled) or on the customer's own Cloudflare account. It is part of the Platform Terms (§12), and a breach of it is a breach of those terms. "You" means the customer that holds the workspace, and you are responsible for what your members, your clients and the agents you connect do with it.

Pooled sites share Studio Makker's Cloudflare account. Abuse on one of them can affect that account's standing and every other pooled customer, so on the pooled placement we act faster where a breach puts the account at risk.

1. What you may not do

You may not use the Service, or let a site you run through it be used, to host, publish, send or facilitate:

  • content that is illegal where it is hosted or read;
  • malware, ransomware, exploit code, or tools for getting into systems without authorization;
  • phishing, credential harvesting, or other content designed to trick people into giving up sensitive information;
  • content that infringes someone else's intellectual property, privacy or publicity rights;
  • child sexual abuse material. There is no tolerance for it: we remove it, end the workspace, and report it to NCMEC and law enforcement as the law requires;
  • fraud, spam, or unsolicited bulk messages;
  • content that harasses or threatens people, or incites violence against them;
  • probing, scanning or testing the vulnerability of the Service, another customer's sites, or the underlying Cloudflare infrastructure without our written permission;
  • traffic meant to disrupt the Service or degrade it for others, as distinct from real growth in visitors; or
  • anything that breaks Cloudflare's own acceptable-use terms.

2. How we enforce it

We look into reports and suspected breaches, and we take the smallest action that stops the harm:

  1. The content. We remove or disable the specific page, file or form.
  2. One site. If that is not enough, we take the one site offline or make it read-only. Your other sites keep running.
  3. The workspace. Only if a breach goes beyond one site, or keeps happening after notice, do we suspend the workspace or end the plan under Platform Terms §5.6.

Notice first. Before acting, we email the workspace's owners with what we found, which rule it breaks, and what we will do. We give you a reasonable time to fix it, stated in the email.

When we act first. We act without waiting, and tell you as soon as we safely can, only for:

  • child sexual abuse material;
  • malware or phishing;
  • an attack on the Service, another customer or Cloudflare's infrastructure;
  • a court order, or a legal demand that requires us to act;
  • a breach that puts Studio Makker's Cloudflare account at risk on the pooled placement.

Even then, we take the smallest action that stops the harm.

If you disagree. Reply to the notice. A person reviews the action, and we tell you the outcome. An action we took in error is undone, and the affected site is restored as it was.

This policy's enforcement is separate from non-payment (Platform Terms §8) and from the inactivity rule for signups that never finished (§22).

3. Copyright complaints (DMCA)

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act.

Sending a notice

A copyright owner, or someone authorized to act for one, may send a notice to our designated agent (below). The notice must include:

  1. a physical or electronic signature of the owner or the authorized person;
  2. the copyrighted work claimed to be infringed;
  3. the material claimed to infringe, with enough detail to find it (a URL is best);
  4. the sender's contact details: address, phone number and email;
  5. a statement that the sender believes in good faith that the use is not authorized by the owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the notice is accurate and that the sender is the owner or authorized to act for the owner.

What we do

When we receive a complete notice, we promptly remove or disable the material, and we tell the customer whose site carried it, with a copy of the notice.

Counter-notice

If you believe material was removed by mistake or misidentification, you may send our designated agent a counter-notice that includes:

  1. your physical or electronic signature;
  2. the material removed and where it appeared before removal;
  3. a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification;
  4. your name, address and phone number; and
  5. a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district in which Studio Makker may be found), and that you will accept service of process from the person who sent the notice.

After a valid counter-notice, we send a copy to the person who sent the notice. We restore the material 10 to 14 business days later, unless that person tells us they have filed a court action.

Repeat infringers

We end the plan of a customer who infringes repeatedly, in appropriate circumstances.

4. Reporting abuse

Report a suspected breach of this policy to abuse@tryempress.dev. Include the site address and what you saw. A person reads every report.

5. Changes

We change this policy the same way as the Platform Terms (§20). We publish the new version here with its date, and we email workspace owners about a change that narrows what they may do before it takes effect.
